Following this decision, Helvetic Vape, the Swiss association of users of personal vaporizers today releases an official statement and congratulates this historic choice.

The Helvetic Vape Association considers the TAF judgment, which breaks the administrative decision of the FSVO perpetuating the unjustified prohibition of nicotine-containing vaping products in Switzerland, to be a major step forward.
The judgment of the Federal Administrative Court (TAF) of 24 April 2018, published today, is very clear, the Federal Office for Food Health and Veterinary Affairs (OSAV) did not have jurisdiction to prohibit the professional import and the sale of a whole category of products. The TAF, relying on case law, considers that this abuse is a serious fault of the federal administration. The FSVO has 30 days to possibly file an appeal before the Federal Court. The association Helvetic Vape, which denounces this prohibition since 2013, regrets that it took a court decision to begin to make the federal government listen to reason.
The stubbornness of the administration to maintain an unjustified and illegal prohibition since 10 years is symptomatic of the little consideration of the federal officials and of Mr Alain Berset for the right to access the tools of minimization of the damages related to the consumption of nicotine . Switzerland has already fallen far behind neighboring countries, which have long been allowing, without any problem, the sale of nicotine vaping products. The Helvetic Vape Association is now waiting to see how the administration will react to the TAF's judgment and what the consequences will be.
The association Helvetic Vape considers that the introduction of nicotine vaping products on the Swiss market will greatly accelerate the conversion of nicotine users to consumption modes that are much less risky for health than fuel tobacco. The president of the association Mr Olivier Théraulaz explains: « This new perspective will reinvigorate small businesses specialized in vaping that are today at the forefront of the fight against fuel tobacco. It will also enable health professionals to refer their smoking patients to easily accessible products. Finally, it will be much simpler to conduct scientific studies on nicotine vaping in our country. »
